RECITAL:
Please read these Terms and Conditions carefully. These are the general Terms and Conditions governing your access and use of the Al Ghurair Properties sports facilities (the “Facility”). IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, PLEASE DO NOT USE THE FACILITY. By Signing this Letter to use the Facility and/or any of the services or equipment given on the Facility, you agree to be bound by these Terms and Conditions.
NO WARRANTY
The materials, electronic gadgets, equipment, and furniture provided in the Facility are provided in “as is” condition. Al Ghurair Properties does not warrant and is not responsible for the performance, adequacy, operation, or effectiveness of the materials and expressly disclaims liability for any errors or omissions therein. No warranties of any kind, implied, express or statutory, including but not limited to the warranties of non-infringement of third-party rights, performance, fitness for a particular purpose are given in conjunction with the services and materials provided.
LIABILITY & INDEMNITY
1- In no event will Al Ghurair Properties and any of its affiliates/subsidiaries be liable for any damages, losses, injuries (including death), including without limitation direct or indirect, special, incidental, or consequential damages, losses or expenses arising in connection with the usage of the Facility or inability to use by any party, or reliance on the services given or equipment use of the Facility, or in connection with any failure of performance, error, omission, interruption, defect, delay or failure in operation or system failure, even if AL Ghurair Properties, its representatives, are advised of the possibility of such damages, losses or expense. This clause shall take effect to the fullest extent permitted by law.
2- By signing this letter you agree to indemnify and hold harmless and defend Al Ghurair Properties and its affiliates, officers, and employees from and against all claims and suits filed by you or any third parties for damages, injuries to any persons (including death), property damages, losses, and expenses including court costs and reasonable attorney’s fees, arising out of, or resulting from your use of Al Ghurair Centre Facilities or services under this Letter, including all such causes of action based upon common, constitutional, or statutory law, or based in whole or in part, upon allegations of negligent or intentional acts on your part, done by you or your accompany, employees, agents, subcontractors or invitees, Further, if you found liable you shall pay your proportionate share of damages as agreed by the parties or as instructed by Al Ghurair Facility Management or any court of competent jurisdiction over the case.
SUBMISSION
All equipment or services given by Al Ghurair Properties for usage in the Facility shall be deemed and remain the property of Al Ghurair Properties which shall be limited for the use of the user.
VARIATION
These terms and conditions are subject to change by Al Ghurair Properties and can be modified at any time without notice.
REFUND
Under no circumstances the amount will be refunded.
No modification is allowed once booked.
GOVERNING LAW & JURISDICTION
By accessing the Facility or using its products or services, you agree that the law of the United Arab Emirates (UAE) shall govern such access and the provision of such facilities, products, and services and you agree to submit to the exclusive jurisdiction of the UAE courts for any dispute arising thereof.
